Fix typing issues

Pytorch will get tighter type hints for tensors 🎉
Among other things, arithmetic with None is no longer type checks and mypy will complain.

This fixes two issues mypy 1.13 detects with the modified pytorch 2.6.0.dev20241109

I also added some typing issues in tests to this
